Terms of Service & User Agreement

1. The Agreement

This document is a legally binding contract between the client, user, or partner ("User") and FlickaTech Consulting ("the Company", "We", "Us", or "Our"), registered and operating from Jalesar, Uttar Pradesh, India. By availing our services, accessing our digital platforms, or engaging with us through any channel, you acknowledge and agree to these terms in full.

2. Services Offered

FlickaTech Consulting provides technology and digital services including but not limited to:

• Software Development: Web applications, mobile apps, cloud-based solutions, and custom software tailored to client needs.
• Digital Marketing: SEO, PPC, social media marketing, and online brand growth strategies.
• WhatsApp Business API & Automation: Integration, automation, and management of Meta WhatsApp Business API for business communication.
• Tech Training: Skill development programs for professionals and businesses to upskill, reskill, and cross-skill in emerging technologies.
• Data Analytics & Big Data: Business intelligence and data-driven insights for small and medium enterprises.
• IT Consulting: Advisory services on technology adoption, digital transformation, and system architecture.

3. Third-Party Platforms

• FlickaTech Consulting may integrate or use third-party platforms (including Meta, Google, cloud providers, and payment gateways) to deliver services. Users may be bound by the terms, privacy policies, and applicable conditions of such third-party platforms when their services are utilised.
• We are not responsible for the availability, accuracy, or content of third-party platforms and services.

4. WhatsApp Business API & Digital Communication Consent

FlickaTech Consulting develops and manages WhatsApp Business API solutions for its clients. In connection with these services:

• Client Responsibility: Clients using our WhatsApp API integration are responsible for obtaining valid opt-in consent from their end-users before sending any messages via the WhatsApp Business Platform.
• Direct Opt-In: By sharing your mobile number on our website, enquiry forms, or partner platforms, you provide consent to receive service updates, project communications, and relevant notifications via WhatsApp or SMS.
• Marketing Communication: Messages may include service updates, promotional campaigns, project alerts, and digital marketing content.
• Withdrawal of Consent: You may opt out at any time by replying "STOP" or contacting us at [email protected].
• Meta Policy Compliance: All WhatsApp communications facilitated by FlickaTech comply with Meta's Business Messaging Policy.

5. Intellectual Property

• Ownership: All software, code, designs, reports, and digital assets developed by FlickaTech Consulting remain the intellectual property of the Company unless explicitly transferred to the client through a signed agreement.
• Client Materials: Any content, data, or materials provided by the client for project purposes remain the property of the client.
• Prohibition: Copying, distributing, reverse-engineering, or sharing any proprietary FlickaTech materials without written permission is strictly prohibited.
• Legal Action: Violations may result in immediate termination of services and legal proceedings under applicable Indian law.

6. Engagement, Payments & Refund Policy

• All projects are subject to a formal scope of work, timeline, and payment agreement signed between both parties.
• Payments are due as per the agreed milestone schedule. Delayed payments may result in pausing of project deliverables.
• Advance payments / retainers paid are non-refundable once work has commenced, unless otherwise agreed in writing.
• FlickaTech reserves the right to revise pricing for new or extended engagements with prior notice.

7. Account & Credential Security

• Clients are responsible for maintaining the confidentiality of all login credentials, API keys, and access tokens shared for project purposes.
• FlickaTech will not be held liable for any breach arising from the client's failure to secure their credentials.
• All sensitive credentials must be shared only through secure channels as agreed upon during onboarding.

8. Disclaimer of Guarantees

While FlickaTech Consulting strives to deliver high-quality outcomes, we do not guarantee specific business results such as search rankings, sales conversions, or lead volumes, as these depend on multiple external factors including market conditions, platform algorithms, and client-side implementation.

9. Limitation of Liability

To the fullest extent permitted by law, FlickaTech Consulting shall not be liable for indirect, incidental, or consequential damages arising from the use or inability to use our services. Our total liability shall not exceed the fees paid by the client in the preceding 30 days.

10. Governing Law & Jurisdiction

These terms shall be governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Jalesar, Uttar Pradesh, India.
